Company illegally fired former temp in workers’ comp case

A Massachusetts Appeals Court has ruled a medical device manufacturer illegally fired an employee who sued the company over an injury she sustained — and for which she received workers’ comp benefits — as a temp, Insurance Journal reports [1]. In July 2013, while assigned to Dielectrics Inc. by Career Group Staffing Services Inc., Ileana Bermudez was injured when a Dialetrics employee negligently operated a forklift, causing several large metal sheets to fall on her right foot.

Bermudez filed a workers’ compensation claim through Career Group’s insurer. She returned to Dielectrics as a temp in September 2013 and was hired as a full-time employee in December 2013. In July 2015, she filed a third-party action against Dielectrics for negligence over her 2013 injury and was terminated, leading to a retaliation claim.
