H-1B: USCIS makes FY 2021 selections

US Citizenship and Immigration Services announced it received enough electronic registrations to reach the fiscal 2021 H-1B cap and has randomly selected [1] from among the registrations properly submitted. Selected petitioners were to have received notification by Tuesday that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration.

Only petitioners with selected registrations may file H-1B cap-subject petitions for FY 2021, and only for the beneficiary in the applicable selected registration notice.

Registrants’ online accounts will now show one of the following statuses for each registration (i.e., for each beneficiary registered):

RFE, NOID extension. Separately, due to the coronavirus pandemic, USCIS announced an extension for responses to requests for evidence and notices of intent to deny dated between March 1 and May 1.

Any responses submitted within 60 calendar days after the response deadline [2] set forth in the RFE or NOID will be considered by USCIS before any action is taken.

USCIS will provide further updates as the situation develops and will continue to follow CDC guidance.
