Independent contractors: Florida businesses to report their data; pro-Grubhub ruling to be reconsidered

Certain Florida businesses must submit new-hire information for independent contractors to the state’s Department of Revenue. A federal judge must reconsider her ruling that Grubhub Inc. was correct to treat a delivery driver as an independent contractor.

Florida. Florida businesses that have paid independent contractors more than $600 in a calendar year will be required to submit new hire information for the workers to the state’s Department of Revenue as of Oct. 1, JD Supra reported [1].

The report must include the name, address and social security number or other  identifying number assigned to the individual; the date services for payment were first rendered by the individual; and the name, address and employer identification number of the service recipient within 20 days following the first payment to the independent contractor or the date on which the parties entered into the contract, whichever is earlier.

Previously, it was optional for businesses to report independent contractor relationships to the Department of Revenue.

Grubhub. The 9th US Circuit Court of Appeals said a federal judge in California must reconsider her ruling that Grubhub Inc. was correct to treat a delivery driver as an independent contractor, Reuters reported [2]. The ruling in the lower court’s case came just weeks before the California Supreme Court’s Dynamex ruling [3], which ultimately led to the creation of the state’s AB 5 law making IC classification more difficult.
