New Jersey temps to get paid leave; ICs not covered

New Jersey on Oct. 29 joins 9 other states and the District of Columbia in mandating paid sick leave for workers in the state. Gov. Phil Murphy the New Jersey Paid Sick Leave Act into law in May.

The legislation provides eligible employees — including part-time workers as well as workers of temporary services firms — with paid leave for their own medical needs, those of a family member, or other covered reasons.

In September, the New Jersey DOL issued proposed rules regarding the law. Among the proposed rules is clarification on the test by which independent contractor classification is determined. Independent contractors, who are not covered by the paid leave law, will be verified via the “ABC” test currently used under the state’s unemployment compensation law.
