California tech firm to pay back wages in H-1B case

A California IT services firm will pay $173,044 to 12 employees for violations of the federal H-1B visa program, the US Department of Labor announced. Cloudwick Technologies Inc., based in Newark, Calif., paid the employees well below the wage levels required under the H-1B program, and also made illegal deductions from workers’ salaries, the DOL said. Some of the workers that Cloudwick brought from India via the program received as little as $800 net per month, well under the promised salaries of up to $8,300 per month.

According to a San Jose Mercury News report [1], Cloudwick founder and CEO Mani Chhabra said the facts were misrepresented and his company never brought workers from India. Rather, the workers had been master’s degree students whose visas had been recategorized by the DOL.
