Massachusetts’ top court on May 4 appeared reluctant to allow a ballot measure to move forward that would ask voters whether drivers for app-based companies like Uber and Lyft should be treated as independent contractors and not employees, Reuters reported [1].

A key concern among the Supreme Judicial Court justices was that the ballot measure limits app-based service providers’ liability for accidents caused by their drivers.

Massachusetts’ ballot measure is similar to one that was passed by California voters in November 2020; that measure was later ruled unconstitutional [2] — a decision that is still under appeal.
